General Terms & Conditions

 

1. General:
These Terms and Conditions apply to the co-operative agreement between the Mayrhofen-Hippach Tourist Board and individual accommodation providers with regards to the Mayrhofen-Hippach electronic guest card and apply to individual bearers of the guest card. These general terms and conditions have been established in the form of a legally binding agreement with the accommodation providers and subsequently with each individual bearer of the guest card by means of a reference to the aforementioned GTC’s printed on every guest card. Guest card holders have the opportunity to find out further detailed information about the GTC’s in the A – Z Brochure in the “Info Guest Card” section, as well as online under: www.mayrhofen.at/gaestekarte.

 

2. Definition:
All persons staying overnight in a co-operative partner business who are electronically registered as a guest according to current registration requirements will be provided with an electronic guest card free of charge by their hosts for the duration of their stay. The electronic guest card provides guests with the opportunity to enjoy the benefits of many services and lower rates provided by Tourist Board partner companies. On presentation of an electronic guest card, guests will be informed by associated partner businesses of their preferable services and any lower rates that may apply.

 

3. Services/Disclaimer:
Bearers of the electronic guest card are entitled to the services/discounts established according to the co-operative agreement between the Tourist Board and partner businesses. Guest discounts apply explicitly to those agreed between the Tourist board and partner businesses. The contractual relationship between the partner business and bearer of the electronic guest card remains essentially without change. The cardholder acknowledges that any promotion rules and/or the general business conditions of any contractual agreements he/she enters into with a partner business apply. Furthermore, that individual services provided by certain partner businesses may not be available during the entire duration of guests’ stay due to varying operating times and/or weather/seasonal conditions. Use of the services offered will by no means result in the creation of a contractual relationship between the card bearer and the Tourist Board Mayrhofen-Hippach and/or the accommodation provider. Use of the electronic guest card associated services results only in a contractual agreement between the guest and partner business offering the service. The bearer of the card acknowledges that the Tourist Board Mayrhofen-Hippach is entitled to terminate the agreement with individual partner businesses for any significant reason during the period of the agreement and, if need be, during the valid period of the guest card. In this case, the bearer of the guest card is under no circumstances entitled to make any claims against the Tourist Board or the accommodation provider – with whom he/she is not engaged in a contractual relationship – or against the partner business that is affected by the terminated agreement.

Services associated with the guest card may not be used in conjunction with services provided by other discount cards (e.g. Zillertal Activcard, Bonus Cards) or combined with any other concessionary agreements the guest may enjoy, such as package tour contracts or other discounts/vouchers. Guests are free to select which discounted service that applies most beneficially to him/her personally.

 

4. Issue of the Guest Card:
The accommodation provider participating in a co-operative agreement is required to register guests electronically and provide him/her with an electronic guest card for the duration of his/her stay, regardless of how long that may be. Consequently, every guest up to the age of 15 years shall also receive an electronic guest card and be entitled to the associated services, even if he/she is not obliged at this age to pay the tourist registration taxes.

The following conditions apply to the issue and use of the electronic guest card.

 

5. Non-transferability/Loss:
The electronic guest card is non-transferable and only valid in conjunction with presentation of a valid photo ID. The guest card may only be used by the guest identified on the card. Guests are not entitled to compensation or replacement services in the event of non-utilization of the services concerned. Loss/damage as well as technical deficiencies of the guest card must be reported by the guest to the accommodation provider without delay. When possible, the guest will then be immediately issued with a new guest card. As soon as a new card is issued, the lost card loses its’ validity with immediate effect.

 

6. Validity:
The electronic guest card is valid during the period of time ranging from the date of arrival, up to and including the date of departure when it automatically loses its’ validity.

 

7. Prices and Child Discounts:
The prices and/or conditions determined by the Tourist Board Mayrhofen and its’ partner Businesses apply as well as the conditions for the provision of services for children and adults. Child discounts depend on the tariff regulations of each individual partner business. The guest card and valid photo ID must be presented for inspection by the partner businesses for child discounts to be taken into consideration.

 

8.Use:
The card holder is obliged to present the guest card as well as a valid photo ID to the partner business on demand. The contractual services may otherwise be denied. The validity of the guest card will be checked by the partner business.

 

9. Abuse:
In cases of improper use of the electronic guest card, the partner business is entitled and obliged to confiscate the card without offer of replacement. The card holder is liable for card misuse by a third party. Misuse of the card may lead to criminal proceedings pursuant to national law.

 

10. Liability of the Tourist Board Mayrhofen-Hippach:
The Tourist Board Mayrhofen-Hippach accepts no liability whatsoever for its‘ co-operative partners for any individual conditions or functions, as well as the unlimited temporal availability of the electronic guest card. Furthermore, each guest acknowledges that the services associated with the guest card can by no means be constituted as a contractual agreement. For this reason, the guest may not make any claims against the Tourist Board Mayrhofen-Hippach for any damages or compensation resulting from the non-provision or inadequate provision of contractual services. Any claims regarding breach of contract are to be put to the respective partner business of the Tourist Board Mayrhofen-Hippach.

 

11. Jurisdiction and Applicable Law:
Austrian business and substantive law applies to the co-operative agreement between the Tourist Board Mayrhofen-Hippach and the accommodation provider. The rules according to private international law and the UN Purchasing Laws will not be taken into consideration. The courts responsible for the Tourist Board Mayrhofen-Hippach in A-6290 Mayrhofen registered offices shall have venue and jurisdiction.
